Irrevocable funeral accounts are considered a non-asset by Medicaid. Once set up and funded, the money set aside to fund your loved one’s funeral cannot be touched until after their death and then only to fund their funeral in accordance with the arrangements set in place.

It is important to note that New Hampshire law dictates that if the individual themselves set a plan in place and funded it previously, the arrangements must be carried out to the extent that they have been arranged and funded for (RSA 290:20). In the rare event that the money in the account reaches a point where there are more funds available than are necessary to pay the expenses, the excess funds will be returned to the Estate of the decedent. As a result, those funds may be subject to claims by the State of New Hampshire or the United States Government (RSA 325:46-a VI)
